These Terms and Conditions is an agreement between you and CareerCAD that provides you license to use online assessments, e-learning courses, counselling, and training services and allows you right to view or use digital content and assets such as data, text, documents, photographs, graphics, audios, videos, illustrations, webinars, software and other electronic services (the “Services”) that are available on this website (“the Website”) and third party websites.
From time to time, we may update/modify these Terms to reflect new terms of understanding for the Services. Such modifications of Terms will be effective from the day when they are posted on the website, unless stated otherwise. You agree to abide by the most current version of the Terms, as revised Terms will supersede all previous Terms. If you do not choose to accept the changes to the Terms, you may cancel your access to the website and the Services as referred under termination. Your continued use of the Website and the Services after changes become effective shall mean your acceptance of these changes.
By accessing the website and the Services, you understand and agree that we may change the Website and Services at any time, including removing, deleting or modifying any content thereon.

You agree that the access to the Services that you obtain after registering for the assessment, e-learning, training, and/or counselling, and/or other services on the website are the access credentials (“Access Credentials”) needed to access or use the Services. These Access Credentials are confidential and provided only to you to access the Services. Any user other than you shall not use these Access Credentials to access and/or the services.
To use the Services, you will need Access Credentials (username and password); therefore, you also agree that Access Credentials shall be kept confidential and any, and all, activities that you subscribe. You agree to notify us promptly of any unsolicited activity under your subscription or any breach of security. We are not liable for any loss or damages that you may incur if someone else uses your Access Credentials, with or without your knowledge. You shall be responsible for any losses suffered by us and/or any third party, arising out of unauthorized access of your Access Credentials.
You should register with a valid personal e-mail address that you access regularly so that moderation emails can be sent to you. You should refer to the Privacy Policy for additional details on how we handle personal information and Sensitive Personal Data /Information (SPDI).
You agree and accept that we have the right to continuously improve the Services on the Website and may change the Services at any time. It is your responsibility to make sure that you utilize service/s licensed to you within the Service validity period, as applicable to the respective service.

We try every effort to ensure that the Services are up and running; however, all online services suffer occasional disruptions and outages, and you agree that we are not liable for any disruption, delay, loss, wrong delivery, non-delivery of services, information, or content materials you may suffer as a result of such disruptions and outages on the Website and websites of third-party sites. You also agree that we are not liable for system or Service outages caused by third parties, including without limitation, any server hosting the Services, any internet service providers, any third-party sites or internet facilities or networks.
The Website and/or the Services may be inaccessible due to scheduled or unscheduled maintenance, updates, power outages, system failure, extended downtime and other interruptions. During such period you may not be able to access our Service. We do not guarantee the availability of the service materials or content at all times, and we shall not be held liable for any issues relating to withdrawal of licensor content under the Services.
You agree that there is possibility that Services provided on any third-party site could include inaccuracies or errors, or information or materials that may violate these Terms. While we attempt to ensure the integrity of the Services on third-party sites, we make no guarantees of Service completeness or correctness on third-party sites. In the event you come across any situation, in which Service completeness or correctness is in question, you may intimate us at info@careercad.com (subject line “Inaccuracies in Services on Third Party site”) on such event along with a description of the Services to be checked, the location (URL), and information sufficient for us to contact you. We will make efforts to address the concern in the best way possible.
We offer reports and/or certificates or other acknowledgements to you (as applicable) on successful completion of assessments and/or courses licensed to you. Such offer is subject to your successful completion of the assessments or courses. The decision whether certificate/s should be awarded, or which type of reports should be provided to you will solely be the discretion of CareerCAD’s management team. Such decision shall be based on the standards of performance and success defined for the service under consideration.
Access to the Service will be provided only after the receipt of required Service fee mentioned against the Service on the website or conveyed through other means of written or oral communication. The service fee shall be paid through the payment gateway provided on the website. Any attempt to override the payment process by any means is illegal and will be liable for legal prosecution. In case of booking a Service (such as counselling), the fee payment should be made prior to receiving booking confirmation.
Cancellation of a service which has been already paid for is not allowed; however, if you wish to reschedule the use/delivery of the service, such as in the case of counselling, to a future date and time, you can follow the step-by-step process mentioned on the Website for the purpose. Rescheduling of a service is allowed only once; any attempt for further rescheduling will not be allowed.
Cancellation of the booking for a service will be considered only if the request is made within the stipulated time period, as specified on the Website against specific Services, post booking the service. However, the cancellation request will not be considered after the payment for the service. It is your responsibility to evaluate the usefulness and/or effectiveness of the service and decide whether the respective Service meet your requirements or not. When you decide to pay for the service, it is assumed that you have already evaluated the service and made an informed decision.
You agree and accept that payment once made for any service shall not be refundable, unless there is undue delay in service delivery or non-delivery. Temporary delay in delivery or non-delivery may happen due to disruptions in the delivery process caused by occasional system failure, power outages, extended downtime, scheduled or unscheduled maintenance, or updates. In such cases, the delivery will be rescheduled to a future date and time by CareerCAD‘s management team. However, it is your responsibility to intimate such events to the team via approved means of communication. However, despite such effort, if the delivery is further delayed or does not materialize, then you may request for a refund of the payment. The final decision to refund or not is the prerogative of CareerCAD management team.
Commitment fee or advance amount paid towards any services, such as placement services (for studies, vocational training or job in foriegn countries), will not be refunded, unless there is any failure or undue delay in service delivery. Undue delay is defined as later than 18 months. However, any failure from the service recipient to meet the conditions of eligibility, such as not securing required academic or extra academic certificates, etc., and integrity, such as not being honest in information provided, cheating, forgery, etc., will lead to automatic relinquishing of such commitment fee or advance amount.
Subject to your compliance with the Terms and the law, you may access and use the Services.
You may have access to the Service by completing and submitting the online registration form available on the respective page. By submitting the registration form, you agree to register to the Service and accept the Terms and you shall be bound by any other applicable terms, policies and guidelines issued by us or third-party content and/or service provider during the assessment.
Your access to and use of the Service licensed to you is limited for the duration specified against the Service on the website. You can reach out to the support team by writing an email to info@careercad.com for details about the Services, which are not provided on the website. You are required to capture the ‘name of the Service’ in the email subject line. You shall cooperate and extend reasonable support to the respective team in order to address your queries.
Where we provide content and materials in connection with the Services, including without limitation the tools, access to third party products and site, referred as “CareerCAD Content” or “Licensor Content” (as applicable). All the respective content remains the proprietary property of the person or licensor or entity supplying it (or their affiliates or third-party providers) and is protected, without limitation, pursuant to relevant copyright and intellectual property laws.
You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the CareerCAD Content or Licensor Content (as applicable), for which you have registered, solely for your personal, non-commercial, educational purpose, in accordance with the Terms associated with respective Services. All other uses are expressly prohibited, without our prior written consent.
We respect all copyright, intellectual property rights, privacy and defamation and other laws relating to content and information and will not entertain any violation of such laws.
All rights not expressly granted herein under these terms are retained by respective content licensors and these terms do not grant any additional licenses (express or implied) for such third-party content.

With respect to ‘service of performance’ or ‘usage of trade’, CareerCAD and its suppliers, licensors and vendors do not warrant that the services will be uninterrupted, error-free or secure, that defects will be corrected, or that the services, the servers on which the services are hosted or any services available on any third party platform are free of virus or other harmful components. No opinion, advice or statement of CareerCAD, its licensors, suppliers or vendors, whether through use of services or on third party platforms, or otherwise, will create any warranty. Your use of the services, including without limitation any services provided on any third-party platform, are entirely at your own risk.
You agree to indemnify, defend and hold CareerCAD, its suppliers, partners, licensors and their respective officers, directors, employees, consultants, representatives harmless from and against any and all claims, liability, damages, losses, costs and expenses (including attorneys’ fees) arising from (a) the content you post or submit, (b) your use of the Services (c) your violation of these Terms, or (d) your violation of any rights of a third-party. Your indemnification obligation will survive the termination of these Terms and your use of the Services. CareerCAD reserves the right, at its own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, and in such case, you agree to cooperate with CareerCAD’s defense of such claim.

The sole and exclusive total aggregate liability of CareerCAD for all damages, losses and cause of action, whether in contract, tort (including without limitation, negligence) or otherwise, shall be the total amount paid by you to CareerCAD for the product registered in the ninety (90) days before the event giving rise to your claims.
No communication of any kind between you and CareerCAD or its representative constitute a waiver of any limitations of liability hereunder. We make no warranties of any kind, expressed or implied, with respect to any products or Services sold on or through the website or partner sites. Multiple claims will not increase the monetary damages limit stated herein.

The failure of CareerCAD or any of its third-party service providers, or its licensors to act with respect to your breach or anyone else’s breach on any occasion shall not constitute a waiver of its right to act or provision of Terms, with respect to future or similar breaches. The failure of CareerCAD to comply with these Terms because of an act of God, war, fire, riot, terrorism, earthquake, actions of the state, central or local government authorities or for any reason beyond the reasonable contract of CareerCAD, shall not be deemed a breach of these Terms.
The headings used in these Terms are for your convenience and reference. These headings do not limit or affect these Terms. The Terms, together with those items made a part of these terms by reference, make up the entire agreement between us, relating to the site.
